Welcome to Aqualeora. These Terms of Service apply when you visit or make a purchase through our website.
By using our website or placing an order with us, you agree to these Terms of Service. Please read them carefully before placing an order.
These Terms do not affect any statutory rights you have under UK consumer law.
1. About Aqualeora
This website is operated by:
Aqualeora
Legal business name: Aqualorea

2. Using our website
You may use our website for lawful purposes only.
You must not:
Use the website for fraudulent or unlawful purposes.
Attempt to gain unauthorised access to our website, systems or accounts.
Introduce viruses, malware or other harmful material.
Copy, reproduce or commercially exploit our website or its content without permission.
Interfere with the operation or security of our website.
Use our website in a way that could damage Aqualeora or its reputation.
We reserve the right to suspend or restrict access to our website where reasonably necessary, including for maintenance, security or suspected misuse.
3. Products
We make every reasonable effort to ensure that product descriptions, photographs, measurements and prices displayed on our website are accurate.
However, jewellery is often handmade or assembled individually, so there may be minor variations between products.
Colours shown on your device may also differ slightly from the actual product depending on your screen settings.
Such minor variations do not affect your statutory rights.
Our jewellery should only be used for its intended purpose and handled with reasonable care.
4. Jewellery care
To help keep your jewellery in good condition, we recommend following any care instructions provided with your order.
Unless specifically stated otherwise for a particular product, jewellery may be affected by:
Water and prolonged exposure to moisture
Perfume and cosmetics
Lotions and creams
Chemicals and cleaning products
Chlorine and swimming pools
Excessive heat
Physical impact or pulling
Normal wear and tear
Damage caused by improper use, accidents or failure to follow reasonable care instructions may not be considered a manufacturing fault.
Nothing in this section limits your statutory consumer rights.
5. Product availability
All products are subject to availability.
If an item becomes unavailable after you place an order and we cannot fulfil it, we will contact you and provide an appropriate refund where required.
We may limit the quantity of particular products that a customer can purchase where reasonably necessary, for example where there is limited stock or suspected fraudulent activity.
6. Prices
All prices displayed on our website are shown in GBP (£) unless otherwise stated.
The total price of your order, including applicable delivery charges and any other mandatory charges, will be displayed before you complete your purchase.
If Aqualeora is required to charge VAT, applicable VAT will be included or clearly identified in accordance with UK law.
We reserve the right to change our prices at any time. However, changes will not affect an order that we have already accepted.
We take reasonable care to ensure that prices are accurate. If we discover an obvious pricing error, we will contact you as soon as reasonably possible.
If an order has not yet been accepted and the price displayed was clearly incorrect, we may cancel the order and refund any payment you have made.
7. Promotions and discount codes
From time to time, Aqualeora may offer promotional codes, discounts or special offers.
Unless otherwise stated:
Discount codes must be entered at checkout.
Only one promotional code may be used per order.
Promotional codes cannot be exchanged for cash.
Promotional codes cannot be applied retrospectively to previous orders.
Promotional codes may have an expiry date or other conditions.
Where a promotion has specific terms, those terms will be displayed alongside the promotion.
We will not use promotional terms that unlawfully restrict your statutory consumer rights.
8. Placing an order
When you place an order through our website, you are making an offer to purchase the products in your order.
Before completing your order, you will have an opportunity to review your order and correct any errors.
You are responsible for ensuring that the information you provide is accurate, including:
Your name
Delivery address
Billing information
Email address
Product selection
Quantity
Size or other relevant product options
After you place an order, you will receive an order confirmation email.
An order confirmation does not necessarily mean that your order has been accepted. Your order is accepted when we confirm that the products have been dispatched, unless we tell you otherwise.
We may decline or cancel an order where there is a genuine reason to do so, including where:
A product is unavailable.
There is an obvious pricing or product description error.
We reasonably suspect fraudulent activity.
We are unable to deliver to the address provided.
There has been an obvious technical error.
If we cancel an order after you have paid, we will refund the amount you paid for the cancelled order.
9. Payment
Payment must be made using one of the payment methods available at checkout.
Payment is processed securely through the payment provider selected at checkout.
We do not store your full payment card details.
If your payment is declined, your order may not be accepted or may be cancelled.
10. Delivery
We will provide the available delivery options and applicable delivery charges at checkout.
We will aim to dispatch orders within the timeframe stated on our website.
Unless a different delivery period has been agreed with you, goods purchased online should generally be delivered without undue delay and no later than 30 days after the contract is entered into, subject to applicable law.
Delivery times provided by carriers are estimates and may occasionally be affected by circumstances outside our reasonable control.
If there is an unexpected significant delay, we will contact you where reasonably possible.
11. Incorrect delivery information
You are responsible for providing an accurate delivery address at checkout.
If you provide an incorrect address and the order has already been dispatched, please contact us as soon as possible.
We will make reasonable efforts to help, but we cannot guarantee that an address can be changed after dispatch.
This does not affect your statutory rights.
12. International orders
We may offer delivery to countries outside the UK.
International customers may be responsible for customs duties, import taxes, handling charges or other fees imposed by the destination country.
These charges are generally outside Aqualeora’s control.
Before placing an international order, you should check whether additional charges may apply to your order.
Where Aqualeora is legally required to collect taxes or duties at checkout, these will be displayed where applicable.
13. Risk and ownership
Unless otherwise required by law, the risk of loss or damage to goods passes to you when you, or a person you nominate, physically receives the goods.
Ownership of the goods passes to you once we have received full payment for the goods.
Nothing in this section affects your statutory rights.
14. Cancellations and returns
Your statutory cancellation and return rights are explained in our Refund & Returns Policy.
For most online purchases, UK consumers have a statutory right to cancel within 14 days of receiving the goods, subject to applicable exceptions.
You may also have additional rights where goods are faulty, not as described or otherwise do not conform to the contract.
Our Refund & Returns Policy forms part of these Terms of Service.

15. Faulty or incorrectly supplied products
Aqualeora is responsible for ensuring that products supplied to consumers comply with applicable UK consumer law.
Products should be of satisfactory quality, fit for purpose where applicable and as described.
If you receive an item that is faulty, damaged, incorrect or not as described, please contact us.
Your statutory rights may include a repair, replacement, price reduction or refund depending on the circumstances.
Nothing in these Terms limits or excludes rights that cannot legally be limited or excluded.
16. Personalised or customised products
Some Aqualeora products may be personalised or made specifically according to your instructions.
Where a product is genuinely made to your specifications or clearly personalised, the usual statutory 14-day cancellation right may not apply.
However, personalised products remain covered by your statutory rights if they are faulty, incorrectly made or otherwise do not conform to the contract.
Any applicable restrictions will be clearly explained before you place your order.
17. Earrings and hygiene
Where jewellery is supplied in sealed packaging specifically for health or hygiene reasons, statutory cancellation rights may be affected if the seal is broken after delivery, where the legal exception applies.
We will not automatically refuse a return simply because an item is an earring.
Please see our Refund & Returns Policy for further information.

Unless otherwise stated, all content on the Aqualeora website belongs to Aqualeora or is used by us with permission.
This includes, but is not limited to:

Contains personal information about another person without permission.

If you submit a review, you should only provide an honest account of your genuine experience.
Aqualeora may moderate or remove content that breaches these requirements or applicable law.
We will not falsely present reviews as genuine customer reviews.
20. Website availability
We aim to keep our website available and functioning correctly, but we cannot guarantee that it will always be available or error-free.
The website may occasionally be unavailable because of:
Maintenance
Technical problems
Security issues
Internet or hosting problems
Events outside our reasonable control
This does not affect any rights you have regarding products you have purchased from us.
21. Links to other websites
Our website may contain links to third-party websites.
These links are provided for convenience and do not mean that Aqualeora endorses or controls those websites.
We are not responsible for the content, availability or policies of third-party websites.
22. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits our liability for:
Death or personal injury caused by our negligence.
Fraud or fraudulent misrepresentation.
Faulty goods where liability cannot legally be excluded.
Goods that are not as described.
Any other liability that cannot legally be excluded or limited.
For consumers, we will only seek to exclude or limit liability where the law permits us to do so.
Our Terms are not intended to remove or reduce your statutory consumer rights.

25. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.
The version that applies to your order will be the version in force when you place your order, unless a change is required by law or otherwise agreed with you.
The latest version will always be available on our website.
26. Complaints
If you have a problem with your order or our service, please contact us first so that we can try to resolve the issue.
Email: hello@aqualorea.com
Please include your order number and explain the issue clearly.
We will aim to respond as soon as reasonably possible.
27. Governing law
These Terms are governed by the laws of England and Wales, unless you live in Scotland or Northern Ireland and applicable consumer law gives you the right to rely on the laws of your home jurisdiction.
If you are a consumer living in the UK, you will retain any mandatory protections provided by the law that applies to you.
28. Disputes
We hope to resolve any disagreement with you informally.
If we cannot resolve a dispute, you may have the right to bring legal proceedings in the courts of the part of the UK where you live.
Nothing in these Terms prevents you from exercising any statutory rights available to you.
29. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the extent necessary.
The remaining provisions will continue to apply.
30. Entire agreement
These Terms, together with the information provided on our website, our Refund & Returns Policy, Privacy Policy and any other policies specifically incorporated into your order, form the agreement between you and Aqualeora regarding your purchase.
